According to the authority vested in me under section 9(c) of the Restriction of Advertising of Tobacco Products for Smoking Law - 1983 (hereinafter: the Law), and with the approval of the Knesset Finance Committee, I order as follows:

1. The wording of the warning as set down in section 9(a) of the Law is to be replaced by:
(1) In respect of section 4(b) of the Law:
"Cigarettes cause illness and premature death";
(2) In respect of section 7 of the Law: one of the wordings listed in the first supplement (hereinafter - the list) is to be replaced every two months by the wording following it in the list;
(3) In respect of section 9(a) of the Law, one of the wordings listed in the 2nd supplement; the wordings will be replaced in such a manner which will ensure their regular appearance so that all the wordings are equally divided among the packets of the same label;
In respect of this paragraph, the wordings will be considered as being equally divided when each wording appears on 6.33% to 10.33% of the packets of the same label of the same manufacturer after production in the manufacturer's plant, in respect of a tobacco product produced in Israel or in an importer warehouse in respect of an imported tobacco product;
(4) Notwithstanding that stated in sub-paragraph (3), the external packaging of a tobacco product for retail marketing, in which there are several packets, each one of which is marked according to the provisions of this Order, shall bear a warning "Smoking Kills".

2. Instead of the size of the lettering in the wording as provided in the Law, in respect of sections 4(b) and 7 of the Law, the word "warning" will be printed in "Haim Bold" lettering, while all other words will be printed in "Haim Narrow" lettering, the overall area of the warning will be at least 5 percent of the advertisement, and the lettering will be printed over this area except for the thin white frame around; in warnings where the wording includes "Ministry of Health", these words will appear in smaller lettering than the lettering of the warning.

3. (a) The warning in respect of sections 4(b) and 7 of the Law, will be printed in one line, in black letters against a white background surrounded by a black frame which is the same width as the "Haim Bold" lettering in the warning.
(b) The warning referred to in section 9(a) of the Law -
(1) Will be designed as described in the second supplement including the reference (proportions), however the importer or the producer may use a different shade of red from the shade of red stated in the said supplement, if the shade which he wishes to use is presented to the manager, as defined in section 6, and the manager did not express his objection to this within 30 days from the date on which it was presented to him;
(2) The area thereof will be 30% of the area of each of the two main sides of the tobacco product packaging.
(c) Notwithstanding that stated in sub-section (b), the importer or producer may adjust the warning to the size of the packaging instead of adapting the warning to the proportions as appear in detail 1(a) of the second supplement, provided that after the manager has approved in advance that the warning complies with the following:
(1) size of the packaging will be 32% of the area of each of the two main sides of the packaging
(2) The size of the lettering and the marking within the frame of detail 1(a) of the second supplement, will be adapted to the height of the frame, while maintaining an internal proportion between all the letters themselves and the marking.

4. With regard to the warning in the list or in the second supplement, which does not contain the words "Ministry of Health", the advertiser may include in the advertisement, outside the wording in the frame, the words "Publication of the warning is obligated by Law".
4A. A warning according to section 9(a) of the Law will appear in the lower front section and on the rear side of the cigarette pack and on all other packaging of tobacco products for smoking which are sold retail, while on the front of the pack the warning will be in Hebrew and on the rear side in Arabic.

5. The inception date for this Order is 45 days after its publication.

6. An importer or producer of tobacco products will notify the general manager of the Ministry of Health or any one who is authorized in this respect (hereinafter: the manager), the name on each label of tobacco products which he advertises; within two weeks of receipt of the said notification, the manager will decide concerning the first warning wording for each label in respect of paragraph 1 and it will be replaced in accordance with the frequency as stipulated.
